Terms of Service

These Terms of Service ("Terms") govern your use of the Spine mobile application (the "App") and the website spineapp.app (the "Site"), provided by CB Scala Limited, a company registered in Malta under registration number C 115983, with registered office at 47 Triq Ghajn Rasul, San Pawl Il-Bahar, SPB 3673, Malta (VAT MT32857612) ("we", "us", "our").

By downloading, accessing, or using Spine, you agree to these Terms. If you do not agree, do not use the App or the Site.

1. What Spine is — and what it isn't

Spine helps you assess and improve your posture through a posture score, measurements, and guided exercises.

Spine is not a medical device and does not provide medical advice, diagnosis, or treatment. The posture score, angles, and exercises are provided for general informational and wellness purposes only. Always consult a qualified healthcare professional before starting any exercise programme, especially if you have a pre-existing condition, injury, or pain. Stop any exercise immediately if you feel pain or discomfort. Never disregard or delay seeking professional medical advice because of anything you read or do in the App.

2. Eligibility

You must be at least 16 years old to use Spine. By using it, you confirm that you meet this requirement.

3. Licence to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use, subject to these Terms.

4. Subscriptions, billing, and cancellation

• Spine offers paid subscriptions, sold and processed through Google Play. Applicable prices and any free-trial terms are shown in the App before you purchase.
• Subscriptions automatically renew for the same period unless you cancel at least 24 hours before the end of the current period. Your payment method is charged at renewal.
• You manage and cancel your subscription through your Google Play account. Uninstalling the App does not cancel your subscription.
• If a free trial is offered, it converts to a paid subscription unless you cancel before it ends.
• Refunds are handled in accordance with Google Play's refund policy, in addition to any non-waivable rights you have under applicable consumer law.

5. Acceptable use

You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law; (b) interfere with or disrupt the App or its security; (c) resell, sublicense, or commercially exploit the App; or (d) use the App for any unlawful purpose.

6. Intellectual property

The App, the Site, the Spine name and logo, and all related content and software are owned by CB Scala Limited or its licensors and are protected by applicable laws. These Terms do not grant you any ownership of, or rights in, our intellectual property.

7. Disclaimers

The App and Site are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted or error-free, or that any particular result (including any improvement in posture) will be achieved.

8. Limitation of liability

To the maximum extent permitted by law, CB Scala Limited will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, arising out of or relating to your use of the App. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence).

9. Termination

We may suspend or terminate your access if you materially breach these Terms. You may stop using the App at any time. Sections that by their nature should survive termination (e.g. intellectual property, disclaimers, limitation of liability) will continue to apply.

10. Changes to the App and these Terms

We may modify the App or these Terms from time to time. We will post the updated Terms here and revise the "Last updated" date, and we will notify you of material changes in the App or on the Site. Your continued use after changes take effect constitutes acceptance.

11. Governing law and jurisdiction

These Terms are governed by the laws of Malta, and the courts of Malta have jurisdiction — without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence.
